A - Terms and Conditions
All services may be used for lawful purposes only. Transmission,
storage, or presentation of any information, data or material in
violation of any United States Federal, State or City law is strictly
prohibited. This includes, but is not limited to: copyrighted
material, material we judge to be threatening, obscene, demeaning to
others, or material protected by trade secret and other statute. The
subscriber agrees to indemnify and hold us harmless from any claims
resulting from the use of the service which damages the subscriber or
any other party. Sites that promote any illegal activity or content
that may be damaging to our or any other server or person, are
strictly prohibited. Links to such materials are also prohibited. In
addition, any site selling or promoting bulk email (spam) services is
not allowed, see Server Abuse provision below. We reserve the right to
disable any script/website without notice. We will be the sole arbiter
as to what constitutes violations of these provisions. Upon violation
of these provisions, a lack of action on our part does not preclude
future actions.
B - Server Abuse
Any attempts to undermine or cause harm to a server or client is
strictly prohibited. Harm is defined by hacking, SPAM, DOS, or any
attempt to undermine the quality of service. Penalty, to be determined
at the sole discretion of ARIANA Co., may result in a
fine in excess of $800 and/or lawful prosecution under local and
federal laws. Sites may not use more than 15% of system resources. Any
sites determined at the sole discression of ARIANA Co. to be
detrimental to quality of service for other clients, are not allowed.
C - Refusal of Service
We reserve the right to refuse, suspend, or cancel service at our sole
discretion. Cancellation Policy Shared/eCommerce 30 Day money back
guarantee applies to new accounts. After the initial 30 days,
no refunds shall be issued.
D - Disclaimer
ARIANA Co. will not be responsible for any damages. ARIANA Co..
makes no warranties of any kind, expressed or implied for services we
provide. ARIANA Co.. disclaims any warranty or merchantability or
fitness for a particular purpose. This includes loss of data resulting
from delays, and any and all service interruptions caused by ARIANA
Co.
. and its employees. ARIANA Co.. reserves the right to change
or update policies without notice If any terms or conditions are
failed to be followed it will result in grounds for immediate account
deactivation.
E - Indemnification
Customer agrees that it shall defend, indemnify, save and hold ARIANA
Co.
. harmless from any and all demands, liabilities, losses, costs
and claims, including reasonable attorney's fees asserted against
ARIANA Co.., its agents, its customers, officers and employees, that
may arise or result from any service provided or performed or agreed
to be performed or any product sold by customer, it's agents,
employees or assigns. Customer agrees to defend, indemnify and hold
harmless ARIANA Co.. against liabilities arising out of; (1) any
injury to person or property caused by any products sold or otherwise
distributed in connection with ARIANA Co..; (2) any material
supplied by customer infringing or allegedly infringing on the
proprietary rights of a third party and (3) copyright infringement. We
have a right to cancel your site with a 10 day notice. If your site is
cancelled by us your money will not be refunded. Customer agrees to be
responsible for all collection fees, court costs, attorneys fees, and
other similar fees. |
